Terms and conditions of CommunityTee

1. Scope, Subject, and Conclusion of the Respective Contract

• These General Terms and Conditions exclusively apply to all contracts between CommunityTee and our customers.

• They apply to both consumers and entrepreneurs. A consumer is any natural person who places an order for purposes that cannot be primarily attributed to their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when placing an order.

• The customer can place an order through CommunityTee's website. After submitting the order, the customer will receive an order confirmation, confirming the conclusion of the contract.

2. Prices, Payment Terms, and Execution of the Purchase Agreement

• The displayed prices do not include value-added tax. As a small business according to §19 UStG (German Value Added Tax Act), we do not charge or display value-added tax.

• Accepted Payment Methods: Credit card and PayPal.

• Payment of the purchase price is due immediately upon conclusion of the purchase agreement.

• In case of direct debit reversals, these additional costs will be invoiced to the customer.

3. Delivery Terms

• Delivery Area: Within and outside the EU.

• Delivery Time: As soon as possible, on average 5-10 working days.

• Shipping Costs: These will be calculated during the ordering process and displayed to the customer before the purchase is finalized.

4. General Return and Cancellation Policy

• Customers have the right to withdraw from the purchase within 14 days without providing any reasons.

• The customer is responsible for the cost of returning the item.

  4.1. Exclusion of the Right of Withdrawal

  The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is essential or which are clearly tailored to the personal needs of the consumer.

5. Warranty and Liability

• The customer has legal warranty rights for any defects.

• If the customer is an entrepreneur, the warranty period is one year from the statutory commencement of the limitation period. For consumers, the statutory warranty period is two years.

6. Privacy Policy

• We take the protection of your personal data very seriously. All personal data is treated confidentially and in accordance with the applicable data protection regulations. For more details, please refer to our privacy policy.

7. Reservation of Ownership

• The delivered goods remain the property of CommunityTee until full payment is received. This statement reflects the concept of the "reservation of ownership," as mentioned earlier, which means that ownership of the goods remains with the seller (CommunityTee) until the buyer has paid for them in full.

8. Final Provisions

• The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (UN-Kaufrecht). This clause specifies that the contract will be governed by the laws of Germany and that the United Nations Convention on Contracts for the International Sale of Goods (CISG), also known as the UN-Kaufrecht, is not applicable.

• If individual provisions of these terms and conditions are or become ineffective or unenforceable, this does not affect the validity of the remaining provisions. This clause indicates that if any part of the terms and conditions is found to be invalid or unenforceable, the rest of the terms and conditions will still remain in effect and enforceable.
